Copyright Question..

Post by lustfullocks » Sat Dec 05, 2009 2:04 am

So i was looking around on ebay and noticed that someone used my picture from my website on their ebay auction to list as colors that they offer to make dreads with. Now normally i wouldn't mind.. had this person actually purchased the hair packets from me.. but i did because i knew she didn't and she is making money using my images. So i asked her politely to take it down unless she was planning on ordering her kankelon through me and she told me that i can't do shit to her because since it's a picture of someone elses product (the kankelon company) that even though i took the picture, they hold the rights to it.

I do believe that she is wrong.. however i don't want to say anything back untill i'm a 100% sure.. what are your thoughts on this? Maybe i am being a dick for telling this girl to take this picture down?

She's wrong. The copyright is yours and if you contact Ebay about it (I think they'll make you fill out a DMCA thing) you should be able to get it removed.

ikickshins is right - YOU created the image, therefore YOU own the copyright to that image.

Totally..you are in the right. Even though it isn't your brand of hair, it is still apart of your product and service. If she's planning on developing a profession in making dreads, she should be taking her own photos. Something tells me hasn't even created enough dreads in her time to list her own colour chart of KK..hence her using your image.
..and you're not being a dick in telling her to remove YOUR image from her auction profiles.
As lame as it is to have to watermark a colour chart, it's worth doing to avoid other's cashing in on your images.
